General Terms of Use of the CONUS Software for Users

Convenience translation. This English version of the terms of use is provided for convenience only and is not legally binding. Only the German version (Allgemeine Nutzungsbedingungen der CONUS Software für Nutzer) is authoritative and governs the contractual relationship. In the event of any discrepancy or conflict between the German version and this English translation, the German version shall prevail.

1. Contracting Parties

represented by its managing director Vincent Paffrath, registered in the commercial register of the Local Court of Cologne (hereinafter: "CONUS"), and the respective user who registers via the CONUS App (hereinafter: "User").

2. Subject Matter of the Contract

2.1. CONUS is the rights holder and operator of the digital information system for medical professionals, which is provided via the CONUS App. The App offers detailed information on medical devices, implants, and other relevant products for use in hospitals.

2.2. The information provided via the App serves the purpose of supporting medical professionals in the preparation and performance of surgical procedures. However, please note that the content and procedures described refer to the medical standard in Germany. Standards in other countries may differ.

2.3. All content is regularly updated by an experienced editorial team with a professional medical background. Nevertheless, CONUS cannot guarantee that the information is complete and up to date at all times, as medical science is subject to constant change.

2.4. The content made available in the App is not to be understood as binding treatment or therapy recommendations. Decisions in medical care must be made by the Users on their own responsibility, taking into account the current state of research and the specific patient characteristics.

2.5. Insofar as automated translations of the content into other languages are offered, these are not subject to any content review by CONUS and may contain errors. Translation errors cannot be ruled out, and it is recommended to refer to the original language.

2.6. The following General Terms of Use apply exclusively to the use of the CONUS App. Deviating terms and conditions are not recognized unless CONUS expressly agrees to them in writing.

3. Registration and Conclusion of the Contract

3.1. Registration via the CONUS App is free of charge. The stored data serves the purpose of later use.

3.2. The creation of a personal user account is required to use the App. All mandatory fields must be completed in full. By submitting the registration form, the User confirms the correctness of their details and agrees to the CONUS terms of use.

3.3. Registration alone does not grant permanent access to the App. Additional paid services can be booked separately.

3.4. The User is obliged to keep their provided data up to date at all times and to ensure that only they themselves have access to their user account. Sharing the password is prohibited.

3.5. There is no entitlement to registration. CONUS reserves the right to reject registration requests or to block existing user accounts.

4. Use of the CONUS App

4.1. The scope of the services offered may vary depending on the license model. Further information can be found in the respective offers and contracts.

4.2. The information and functions provided serve exclusively to support surgical procedures and are not intended for direct application to patients. The User remains responsible for the proper application and verification of the information provided.

4.3. CONUS does not guarantee the permanent availability of the App. Maintenance work or technical failures may lead to temporary restrictions.

5. Liability

5.1. CONUS is only liable in cases of intent and gross negligence. In cases of simple negligence, CONUS is only liable for damages arising from the breach of an essential contractual obligation, whereby the liability is limited to the foreseeable, typical damage.

5.2. CONUS assumes no liability for external content referred to via the CONUS App. Responsibility for such content lies exclusively with the respective operators of the linked pages.

5.3. Liability for damages arising from the use of the information provided is limited to the direct damage. CONUS assumes no liability for lost profits or other indirect damages.

7. Final Provisions

7.1. The law of the Federal Republic of Germany applies.

7.2. Should any provision of these terms of use be invalid, the remaining provisions shall remain unaffected.
